This Terms of Service Agreement (“The Terms”) sets forth the terms and conditions governing the provision of services by Forbes.health (“The Practitioner”). By working with us and using our services, you accept the following terms:
- No Substitute for Medical Advice: The services tendered by the Practitioner shall in no event be considered an alternative to counsel from duly qualified medical practitioners. The Practitioner may only furnish general information pertaining to principles of health improvement.
- Non-Medical Qualification: The Practitioner is specialised in functional medicine but is not medically qualified. Their expertise lies in the field of functional medicine. The Practitioner does not offer medical diagnoses or advice on specific health conditions.
- Consultation with a Doctor: Clients are strongly urged to solicit the guidance of a licensed physician before undertaking any alterations to their dietary regimen, exercise routine, or the introduction of dietary supplements.
- Accuracy of Information: The Practitioner does not warrant the accuracy or authenticity of any information disseminated, as they are not the originator thereof.
- Limitation of Liability: The Practitioner shall not be held liable for any losses incurred by clients arising from reliance upon the proffered advice.
- No Product or Service Recommendations: The Practitioner refrains from endorsing any particular products or services.
- No Guarantee of Results: The Practitioner does not warrant specific positive outcomes, as they lack control over such eventualities.
- HIPAA Coverage: The Practitioner does not qualify as a covered entity or business associate under the purview of the Health Insurance Portability and Accountability Act (HIPAA).
- No Diagnosis or CPT Codes: The Practitioner is incapable of providing any diagnosis or Current Procedural Terminology (CPT) codes for insurance billing purposes.
- Costs: Please be aware that the expenses for the services providing by the Practitioner and laboratory tests are not covered or reimbursed by any (private) medical insurance.
- Program Upgrades: A purchased programme cannot be upgraded to a higher programme during the ongoing programme. However, after completing a full programme, the Practitioner can advise on a suitable follow-up.

Scope of services:
The Practitioner obtains a series of laboratory test results on your behalf from Certified Laboratories in the United States, Canada, Europe, and the UK, and provides you with a comprehensive, holistic, or nutrition-related interpretation of those test results. These test results can be exclusively used by you as an educational tool for your personal health purposes.
The practitioner offers round-the-clock accessibility through their Client Portal (Practice Better) for addressing brief inquiries and providing support. Please note that ’24-Hour Access’ is limited to messaging and does not include extended consultation sessions. If clients require a consultation with the practitioner, they must schedule one separately at a rate of 250 Euros per hour.
Acknowledgment:
The Practitioner does not utilize the test reports for medical diagnosing or treating diseases or specific conditions. The information provided is not intended to, cannot, and should not replace a personal consultation with any qualified doctor. We do not accept any liability for any failure to identify any medical condition or disease, as this is explicitly not the purpose of our services.
The Practitioner will provide you with information about products that we believe might benefit you, but such information should not be construed as an endorsement or recommendation for disease treatment. Some products may require a prescription, but we do not dispense or prescribe any prescription products. The information provided is solely for educational purposes and should not be considered professional medical advice and/or a replacement for medical care. We are not responsible for any adverse effects or consequences that may directly or indirectly arise from the information we share with you.
The Practitioner will make reasonable efforts to protect the privacy of your medical information, including any lab test results. However, please note that this information is not covered by doctor-patient confidentiality, nor is it governed by HIPAA.

Exclusion of Warranties
The Practitioner provides their services with reasonable care and skill; however be aware of the following exclusions:
- No Other Warranties: The Practitioner expressly disclaims any other warranty, whether explicit or implied, concerning the services provided. All additional warranties are hereby excluded to the fullest extent allowed by applicable law.
- Accuracy of Laboratory Test Results: The Practitioner does not warrant or guarantee the accuracy of the laboratory test results they receive.
- Quality or Effectiveness: The Practitioner provides no warranty, expressed or implied, regarding the quality or effectiveness of any interpretation, apparatus, advice, treatment, or product. They shall not be held liable for any physical or mental injury or adverse side effects arising from the use of such interpretation, apparatus, advice, treatment, or product.
- Accuracy of Information Provided: While the Practitioner believes in the accuracy of the information they offer, including on their websites, videos, postings, brochures, emails, flyers, and information packets, they cannot guarantee its absolute accuracy. It is your sole responsibility to independently verify such matters through primary sources of information and seek specific professional advice when necessary.
In addition, the Practitioner explicitly disclaim all other warranties, whether explicit or implied, pertaining to these services, to the maximum extent permitted by law.
Limitation of Liability
Your reliance on, purchase, or use of any product, therapy, or modality is at your own risk. Please consider the following:
- No Guarantee of Results: The Practitioner does not guarantee specific outcomes as individual responses may vary.
- Comprehensive Limitation of Liability: To the fullest extent permitted by law, the Practitioner excludes liability for any direct or indirect costs, losses, claims, damages, expenses, or proceedings arising from their services, including information, education, or advice provided.
- Laboratory Results and Suggestions: The Practitioner is not liable for any injury or loss arising from the use of laboratory results and/or dietary, supplement, and lifestyle suggestions.
- Laboratory Names and Prices: The Practitioner is not accountable for changes in laboratory names and prices that may occur due to supplier alterations and other external factors beyond our control. Such variations are not the responsibility of the Practitioner, and it is important for clients to be aware of potential changes.
- Product or Treatment Use: The Practitioner is not liable for any injury or loss resulting from your chosen product or treatment.
- Failure to Identify Medical Condition: The Practitioner is not liable for failing to identify any medical condition or disease, as this is not the purpose of their services.
- Shipping of Completed Human Test Samples: It is the client’s responsibility to coordinate and organise the shipping of completed human test samples via their chosen postal method, such as DHL, FedEx, the Post Office, etc. This is not the responsibility of the Practitioner.
- VAT for Import: The buyer is responsible for paying the applicable VAT (Value Added Tax) for importing our products. All import-related costs, including but not limited to VAT, are solely the buyer’s responsibility. The Practitioner shall not be liable for any delays, fines, levies, or consequences arising from the buyer’s failure to fulfil their import tax obligations.
No Recommendation
